FRANSCHHOEK CELLAR WINES, LOVE YOUR LOCAL TERMS & CONDITIONS

  1. All persons ("the entrants") entering the DGB (Proprietary) Limited Competition ("the promotional competition") agree that the competition rules as set out in these terms and conditions are binding on them. A copy of these terms and conditions is available at www.loveyourlocal.com
  2. Important notice:
    1. These terms and conditions and competition rules contain certain terms and conditions which appear in a similar text style to this clause and which:
      1. may limit the risk or liability of the promoter or a third party; and/or
      2. may create risk or liability for the entrant; and/or
      3. may compel the entrant to indemnify the promoter or a third party; and/or
      4. serve as an acknowledgement, by the entrant, of a fact. 
      5. the entrant cannot be a juristic entity and must be an individual;
    2. The entrant's attention is drawn to these terms and conditions because they are important and should be carefully noted.
    3. Nothing in these terms and conditions is intended to or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrant or the promoter in terms of the South African Consumer Protection Act, 68 of 2008 ("the CPA").
    4. The entrant acknowledges that by submitting his or her entry to the competition he/she has been given an appropriate opportunity to first read these terms and conditions before entering and he/she understands and agrees to the terms and conditions.
    5. All entrants to this promotional competition participate entirely at their own risk. By reading and accepting these terms and conditions, the entrant gives consent to these risks and hereby indemnifies and holds harmless the promoters DGB (Pty) Ltd their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any indemnified party.
    6. Applicable Liquor Laws apply.
  3. ‘The promotional competition’ is valid from 1 August 2023 until 31 December 2023. Entries close at midnight on 31 December 2023. No late entries will be considered.
  4. The competition is open to all except the following:
    1. any director, member, partner, employee or agent of, or consultant to DGB (Pty) Ltd who are the promoters of the competition, or any other companies forming part of the DGB (Pty) Ltd group of companies;
    2. any suppliers, service providers, or contractors of DGB (Pty) Ltd, being a supplier of goods or services in connection with the competition;
    3. any spouse, partner, sibling, parent or child of any of the above.
  5. To be entered into the competition for the Prize:
    1. Consumers must be 18+ years of age
    2. the consumers will need to visit the campaign microsite www.loveyourlocal.com (either by scanning the QR code or going directly to the URL), enter their details and vote for their favourite local (refers to the participating Restaurants / Bistros / Cafes).
    3. the consumer will enter their details and vote for their favourite local (from a drop-down list, showing only participating outlets).
    4. Participating locals will be updated throughout the campaign period.
    5. Consumers can enter multiple times during the campaign period.
  6. Prize:
    1. The Prize:
      1. One qualifying entrant will win a year's supply of Franschhoek Cellar Village Walk Wines (excluding The Last Elephant, Landmark Wines) (hereafter referred to as ‘the Prize’). 1 (one) case per month = total 12 (twelve) cases. All cases will be delivered in one delivery. Varietal selection will be a mixture determined by DGB.
      2. The prize is for the personal use of the winner only, is non-transferable and cannot be resold or exchanged for cash. 
      3. To be eligible to win the Prize, entrants must be natural person residents of South Africa, be in possession of a valid ID and must be 18+ years of age. In addition, to claim their Prize and become a winner a potential Prize winner will be required to provide proof of possession of a valid ID document.
      4. Monthly winners will be selected at random from all entries received within the month.
      5. The winner (s) will be verified by a third-party agency/supplier/partner of DGB.
      6. The winner (s) will be announced 7 (seven) business days after selection.
      7. The winner (s) will be notified via email or telephone call.
      8. Upon permission from the winners, we will include the monthly winner's details in our social media and email communication.
      9. If a potential winner cannot be contacted after three attempts are made within 3 (three) days of the draw, and/or the potential winner does not produce the documentation required to claim their Prize, within 10 (ten) days of being notified that they are a potential winner or such longer period to which DGB (Pty) Ltd may agree, then the potential winner will forfeit their Prize and another potential winner will be randomly drawn to replace them.
    2. The Grand Prize:
      1. One qualifying entrant will win:
        1. (1) A magical 2-night (two-night) getaway to Franschhoek to the value of R20,000. In the event the winner resides outside of Cape Town, all travel costs to get to and from Franschhoek (flights and car hire) will need to be included in the prize valued at R20,000.
          1. Bookings made are subject to the availability of flights and accommodation.
          2. Bookings cannot be made in conjunction with other major social events on the South African special events calendar, special deals or during blackout periods.
        2. (2) 1 (one) Year's supply of Franschhoek Cellar Village Walk Wines (excluding The Last Elephant, Landmark Wines) (hereafter referred to as ‘the Prize’). 1 (one) case per month = total 12 (twelve) cases. All cases will be delivered in one delivery. Varietal selection will be a mixture determined by DGB.
        3. (3) A R5,000 voucher to spend at their favourite local (the winning local).
      2. The prize is for the personal use of the winner only, is non-transferable and cannot be resold or exchanged for cash. 
      3. To be eligible to win the Prize, entrants must be natural person residents of South Africa, be in possession of a valid ID and must be 18+ years of age. In addition, to claim their Prize and become a winner a potential Prize winner will be required to provide proof of possession of a valid ID document.
      4. The grand prize winner will be selected at random ONLY from the pool of entries for the most voted local outlet, for the entire campaign period.
      5. The winner will be selected at random and verified by a third-party agency/supplier/partner of DGB.
      6. The winning local consumer will be announced by the 15th of January 2024.
      7. The grand prize consumer winner will be notified via email or telephone call by the 22nd of January 2024.
      8. Upon permission from the winners, we will include the monthly winner's details in our social media and email communication.
      9. If a potential winner cannot be contacted after three attempts are made within 3 (three) days of the draw, and/or the potential winner does not produce the documentation required to claim their Prize, within 10 (ten) days of being notified that they are a potential winner or a longer period to which DGB (Pty) Ltd may agree, then the potential winner will forfeit their Prize and another potential winner will be randomly drawn to replace them.
  7. General:
    1. The results of the competition will be published on the website www.loveyourlocal.com
    2. DGB (Pty) Ltd’s decision is final in the event that any dispute arises with regard to the competition, and no correspondence will be entered into.
    3. DGB (Pty) Ltd provides no warranties in relation to the Prize. Should the Prize or any part thereof be found to be defective, the winner’s sole remedy will be against the service provider of the defective Prize.
    4. By entering this competition, the winner agrees to participate in such promotional activities related to the competition as DGB (Pty) Ltd may reasonably require, provided that a winner may decline to do so.
    5. By entering the competition entrants acknowledge that DGB (Pty) Ltd may collect personal information about them, which they provide when they enter the competition. DGB (Pty) Ltd undertake to not sell or share this information to or with third parties but may disclose the information if required by law.
    6. The competition is conducted in accordance with the laws of the Republic of South Africa and should any of the competition rules be deemed void or unenforceable, then that rule will be deemed to be deleted and the remaining rules will remain in force.
    7. DGB (Pty) Ltd reserve the right to amend the competition rules in their reasonable discretion should they consider this appropriate, before the competition closes and any such amendment(s) shall be posted on the website www.loveyourlocal.com
    8. By taking part in this competition, each entrant acknowledges his/her understanding of and agrees to comply with each of the competition rules set out above.
    9. A copy of the competition rules is available on the website www.loveyourlocal.com for the duration of the competition.
